Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Lucia Water Solutions ("Company," "we," "us," or "our") concerning your access to and use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms.

Lucia Water Solutions provides water testing, analysis, and purification system installation services, including but not limited to:

  • Free in-home water quality testing and analysis
  • Whole house water purification system design and installation
  • Reverse osmosis and alkaline water system installation
  • Water treatment system maintenance and repair services
  • Commercial water treatment solutions

All services are subject to availability and may vary based on your location within our service area.

2. Free Water Testing

Our free water testing service includes:

  • Complimentary in-home water quality analysis
  • Professional consultation and recommendations
  • Detailed water quality report
  • No obligation to purchase

The free water testing is available to residential properties within our service area. We reserve the right to limit the number of free tests per household or property.

3. Pricing and Payment

Pricing

All pricing for products and services is provided through personalized quotes based on your specific water quality needs and property requirements. Prices are subject to change without notice.

Payment Terms

  • Payment is due upon completion of service unless otherwise agreed in writing
  • We accept cash, check, credit cards, and financing options (subject to approval)
  • Financing terms are subject to third-party approval and separate agreements
  • Late payments may be subject to additional fees as permitted by law

4. Installation and Service

Scheduling

Installation and service appointments are scheduled based on availability. We will make reasonable efforts to accommodate your preferred schedule.

Customer Responsibilities

You agree to:

  • Provide accurate information about your property and water system
  • Ensure access to installation areas
  • Provide necessary utilities (electricity, water) during installation
  • Clear the installation area of personal belongings
  • Be present or have an authorized representative present during service

Installation Standards

All installations are performed according to industry standards and local building codes. We reserve the right to modify installation plans if site conditions require.

5. Warranties and Guarantees

Product Warranties

Water treatment systems and equipment are covered by manufacturer warranties, which vary by product. Warranty terms will be provided at the time of purchase. Our warranties may include:

  • Up to 25-year limited warranties on certain systems
  • Parts and labor coverage as specified in warranty documentation
  • Manufacturer warranties on equipment and components

Warranty Limitations

Warranties do not cover:

  • Damage from misuse, neglect, or improper maintenance
  • Normal wear and tear of consumable parts (filters, membranes)
  • Damage from acts of God, accidents, or events beyond our control
  • Systems modified or repaired by unauthorized parties
  • Consequential or incidental damages

6. Maintenance and Service

Regular maintenance is recommended to ensure optimal performance of your water treatment system. Maintenance requirements include:

  • Regular filter replacements as recommended by manufacturer
  • Annual system inspections and servicing
  • Prompt attention to system alerts or performance issues

Failure to maintain your system as recommended may void warranty coverage.

7. Cancellation and Refund Policy

Appointment Cancellations

You may cancel or reschedule appointments with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee.

Order Cancellations

Equipment orders may be cancelled before shipment or installation. Once installation has begun, cancellation may be subject to fees for labor, materials, and restocking.

Refunds

Refund eligibility is determined on a case-by-case basis. Equipment must be returned in original condition. Installation services are generally non-refundable once completed.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount paid for the specific service or product
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for damages resulting from improper use or maintenance
  • Water quality results are based on testing at time of service and may vary
  • We cannot guarantee specific water quality outcomes due to variables beyond our control

9. Indemnification

You agree to indemnify and hold harmless Lucia Water Solutions, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of our services.

10. Service Area

Our services are available within a 60-mile radius, primarily serving:

New York

  • Rockland County
  • Orange County
  • Westchester County
  • Nassau County
  • Suffolk County

New Jersey

  • Bergen County
  • Hudson County

Service outside these areas may be available upon request and subject to additional fees.

11. SMS/Text Messaging Program

When you opt in to receive SMS/text messages from Pasteur Water System:

  • Program Description: Our SMS program sends service notifications, appointment reminders, water quality alerts, and promotional messages related to our water treatment services
  • Opt-Out: You may opt out at any time by replying STOP to any message. After opting out, you will receive one final confirmation message and no further messages will be sent
  • Help: For assistance, reply HELP to any message or call us at 845-879-2900
  • Message Frequency: Message frequency varies based on your service needs and preferences
  • Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan
  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages
  • Supported Carriers: Our SMS program is supported by all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others
  • Consent: Your consent to receive SMS messages is not required as a condition of purchasing any goods or services from us

12. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Lucia Water Solutions or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

13. Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
